The idea behind a patent has to be entirely new. It must involve an invention that has not been written about in any publications. It must also be non-obvious, meaning that it must have taken more than just general skill to come upon the idea. The idea must also be useful.
Another aspect of patenting that must be watched is whether or not the new idea infringes upon an already existing patent. Early patents in any subject area can be very broad in their scope. If there is an improvement upon an existing patent in a manner that is patentable, it may still infringe upon the previous patent. The new idea must then be licensed by the previous patent holder before it can be patented.
