How Are Patents Enforced?
Once you patent your idea, how will it be enforced? Obviously you have the rights to your invention, but can you be certain that you will be protected? Knowing how your patent is kept safe may put your mind at ease.
In general, patents are enforced through civil lawsuits. Through this lawsuit, the patent owner seeks compensation for infringement and possibly an injunction to prohibit the infringer from doing so again. Infringement is proved by establishing that the accused has used at least one of the claims of the patent. This may extend beyond what is written on the patent due to the doctrine of equivalents.
On the other hand, the accused may challenge the validity of the patent. The grounds for being declared invalid are generally due to a sub-set of patentability. This means that the patent must be non-adherent to patentability requirements.
Most patent rights are enforced through patent licensing without litigation. Patent licensing agreements are basically contracts under which a licensor agrees not to sue a licensee for infringement in return for royalties or some other form of payment.
If your patent follows all of the patentability requirements, there should be no problems with validity. This keeps your patent safe, and keeps you happy.
